GENERAL TERMS AND CONDITIONS

General Terms and Conditions for the provision of services and performance of work by Amsterdam Sport Events BV, established at: Nieuwemeerdijk 13, 1171NA Badhoevedorp. Registered with the Chamber of Commerce under number 52129020. Hereinafter referred to as ASE.


General Terms and Conditions and Regulations of the Dutch Triathlon Series. Hereinafter referred to as DTS.


ARTICLE 1: DEFINITIONS


1.1. In these General Terms and Conditions, the following is understood to mean:


1. Event: The sports events DTS Bosbaan, DTS HLMRMEER, DTS Ouderkerk and DTS Grand Prix Zandvoort to be organized by ASE in any given year.

2. Participant: the natural person who has registered for participation in the Event in a manner permitted by the Organizer.

3. Agreement: the agreement concerning the Participant's participation in the Event.

4. Organizer: the legal entities (in this ASE) with which the Participant has entered into an Agreement.


1.2. These General Terms and Conditions apply to every Agreement.


ARTICLE 2: REGISTRATION AND PARTICIPATION


2.1. A Participant must have reached at least the minimum age established by the Organizer for that Event in the year in which the Event is held, namely 14 years for a Sprint Distance, 16 years for the Olympic and 1/3 Distances, and 18 years for the Half Distance.


2.2. The Participant may only participate in the Event if he has completed the registration form fully and truthfully, if the registration fee has been paid in full no later than the Monday before the Event, and if the Participant has agreed to the general terms and conditions.


2.3. The Participant is permitted to make a limited number of changes to their registration after registration. Any costs associated with this shall be borne by the Participant. Changes may be made up to 14 days before the event.


Chip

At DTS, the MyLaps ProChip system is used. It is not possible to use your own yellow or green ChampionChip. Participants rent the ProChip from MyLaps. The registration fee includes the ProChip rental. Participants must return the chip themselves exclusively at the Bike check-out after the race. In the unlikely event that the chip is lost, the MyLaps fee of €25 per chip must be paid on the spot via debit card.


Honorary prizes

At DTS, every finisher receives a beautiful medal. We have honorary prizes for various Age Groups and Overall Women, Men, and Relay teams. Participants can always inquire at the Mylaps stand to see if they have won a prize. 1st, 2nd, and 3rd prizes are awarded exclusively at the podium ceremony at the event. Prizes will NOT be mailed. Results are available online the same day and can be looked up at www.dutchtriathlons.nl.


Age Groups

DTS uses the following AGE GROUPS:

30-39

40-49

50-59

There must be at least 10 registered persons in an Age Group for it to qualify as a competition and therefore to hold a prize ceremony for 1st, 2nd, and 3rd place. If there are fewer than 10 persons in an Age Group, no honorary prizes will be awarded to the 1st, 2nd, and 3rd place winners, and these persons will be placed in a lower Age Group. Naturally, every participant is listed in the results list, which is also published online on the DTS website.


Finisher Shirts

Finisher shirts can be ordered for €30 during the registration process. Ordered and paid-for Finisher Shirts must be collected by the participant themselves at the registration desk. Sending a finisher shirt by post upon request costs €15.


ARTICLE 3: CANCELLATION


3.1. In the event of cancellation, registration fees will under no circumstances be refunded.


3.2. A registration may be converted to a registration for the same distance at a DTS Event in the same calendar year a maximum of one time. Exceptions to this are the Middle Distance and DTS BOSBAAN. For DTS BOSBAAN, registration can be moved to the first event of the following year. For the Middle Distance, see the rules below. The participant must request a change themselves via info@dtseries.nl. This can be done up to 14 days before the start of the event in question that is to be cancelled. The costs for requesting a voucher and cancelling the current registration amount to:

€40 for a Sprint Relay

€35 for an Olympic Distance

€75 for an OD Relay


Cancel Middle Distance - DTS HLMRMEER


For the DTS HLMRMEER Middle Distance, a separate policy applies regarding the cancellation of the race:


Up to 4 months before the race: 50% registration fee refund

Up to 30 days before the race: 25% registration fee refund

Within 30 days prior to the event, this right expires and no refund is possible.

The participant must request a change themselves via info@dtseries.nl.


Ordered and paid-for extras such as merchandise, finish shirts, race number bands, lock laces, etc., will be sent upon request (shipping costs from €15) or refunded.

Offered promotional items ordered for free (e.g. Black Friday deal) will be forfeited upon cancellation of a Middle Distance registration.


3.3. The Participant has the option to transfer their registration to a person who is not yet registered for the same Event up to 14 days before the Event. Transferring the registration is no longer possible in the last 14 days before the Event. The Participant is expected to arrange this themselves via the Njuko environment. This action is associated with the following costs:


€25 for a Sprint

€40 for a Sprint Relay

€35 for an Olympic Distance

€75 for an OD Relay

€60 for a Middle Distance

€85 for a Middle Distance Relay


3.4. The arrangements referred to in Articles 3.2 and 3.3 cannot both be used for the same registration.


3.5. The Organizer of the Event may decide to cancel the Event due to exceptional circumstances (force majeure). In the event of blue-green algae, high waves and/or unsafe weather conditions, an event may be converted from a triathlon to a Run Bike Run (Duathlon).


3.6. The Organizer's decision to cancel or modify the Event does not create any liability for reimbursement of costs incurred by the Participant in relation to the Event. The rental costs of an ordered wetsuit will be reimbursed at 50% in the event of modification due to blue-green algae or unsafe weather conditions, provided that the wetsuit has not yet been shipped to the Participants. If the Participant has received the rental wetsuit (by mail) and the organization subsequently decides at the last minute to change the race to an RBR, the rental company can no longer refund any rental costs.


ARTICLE 4: LIABILITY


4.1. Participation is at one's own risk. The Organizer is not liable for any damage, however named, that the Participant may suffer as a result of participation. Furthermore, the Organizer is not liable for loss, theft, or damage to property, unless such damage is the direct result of intent or gross negligence attributable to the Organizer. This exclusion of liability also applies to serious types of damage, such as all possible types of damage resulting from injury or death.


4.2. If, notwithstanding the provisions of the first paragraph of this article, the Organizer's liability for damage suffered by the Participant must be assumed, the Organizer's obligation to compensate for such damage shall remain limited to a maximum of the amount paid out by the Organizer's insurer in respect of such damage.


4.3. The Participant must be adequately insured against the risk of damage that he or a surviving relative may suffer as a result of his death, injury, or illness caused by his participation in the Event.


4.4. The Participant acknowledges that participation requires good mental and physical health, and declares that he meets this requirement and has adequately prepared for the Event through training and other means.


4.5. The Participant indemnifies the Organizer against liability for damage that third parties may suffer as a result of an act or omission attributable to a Participant in connection with the Event. The Participant must be adequately insured against the risk of liability for said damage.


4.6. The Participant indemnifies the Organizer against liability for damage that a third party may suffer due to the actions of the Participant during their participation in the Event, unless such damage is the direct result of intent or gross negligence attributable to the Organizer.


4.7. In the event of a liability claim, the Participant must submit it to the Organizer no later than 14 days after the end of the event.


ARTICLE 5: RIGHT OF PORTRAIT


The Participant grants prior permission to the Organizer for the publication of photos, video material, and the like taken during or around the Event, in which the Participant is visible.


ARTICLE 6: PERSONAL DATA


The personal data provided by a Participant is included in a file by the Organizer. By participating in an Event, a Participant grants permission to the Organizer for the necessary use of the personal data for sending information to the Participant and for providing the personal data to third parties for the purpose of sending information to the Participant. By entering into the Agreement, the Participant grants permission to the Organizer to disclose their name and competition results, for example by means of publication in newspapers and via the internet.


Gender neutral


There are three choices for participants to register:


Male (M) / Female (F) / Other (X)


The choice also determines the category in which you are placed regarding the results. There must be at least 10 people registered in an Age Group to qualify as a competition and thus link a prize ceremony for 1st, 2nd, and 3rd place to it. If there are fewer than 10 people in an Age Group, no honorary prizes are awarded to the 1st, 2nd, and 3rd place winners, but they will be honorably mentioned by the announcer. Naturally, every participant is listed in the results list, which is also published online on the DTS website.


REGULATIONS:


The Dutch Triathlon Series (DTS) employs its own team of judges who ensure that the competition proceeds according to the rules. Participants must adhere to our regulations. DTS judges have the authority to disqualify participants who do not comply with the rules as described below.


  • Participants are not permitted to use music devices such as earbuds and headphones in any part of the event.
  • Participants must follow the instructions of traffic controllers and police officers at all times and must be mindful of any vehicles present.
  • Comply with applicable traffic rules at all times (unless indicated otherwise by traffic controllers and police officers) and understand that the course is accessible to the public and traffic. Sections closed to traffic may also be used by emergency services and event-related vehicles during the event. Therefore, adhere to traffic rules at all times. Driving is on the right.
  • The DTS medical team is authorized to remove athletes from the competition if they deem continuation irresponsible.
  • We ask all participants to behave well and in a sporting manner, and to treat other participants, event staff, and volunteers politely and respectfully.
  • Disposing of waste is only permitted in designated waste zones. The waste zones are located around the aid stations and are clearly marked. If a participant disposes of waste outside this zone, he or she will be disqualified.
  • If a participant chooses to withdraw from the competition, he/she must notify the jury as soon as possible. If this is not complied with and a search and rescue operation is initiated, the associated costs will be charged to the participant concerned if he/she is at home or in a hotel/accommodation at that time.
  • The DTS organization reserves the right to change regulations, courses, and locations at any time. However, participants must be informed of this before the start of the competition, unless the change directly relates to the safety of the athletes.
  • Wearing headphones or earplugs is not permitted during the swimming, cycling, or running events. Participants (m/f) in the DTS may not appear with exposed skin.
  • move the upper body onto the cycling and running course.
  • Every participant must familiarize themselves with the course; it is their own responsibility to follow the correct route (except for deviating instructions from traffic controllers, police officers, and the organization).
  • DTS reserves the right – when weather conditions require it – to assign the competition Duathlon status for the safety of the participant. In this case, no (partial) refund of entry fees will take place. If weather conditions are so poor that the safety of participants in a duathlon cannot be guaranteed, the DTS organization may choose to cancel the event entirely. In the event of cancellation, the entry fee will not be refunded.
  • The issued start numbers must be visible throughout the entire cycling and running section.


SWIMMING RULES


  • During the event, a participant must have the swimming cap obtained at registration. This must be worn at all times while the participant is in the water.
  • Any adjustments to the swimming event will be communicated during the participants' briefing, based on the prevailing weather conditions, water temperature, and any changes to the swimming distance.
  • Flippers, paddles, snorkels, and flotation devices are prohibited.
  • Swimming or diving goggles may be worn.
  • If a participant receives assistance during the swimming segment (for example from canoeists or the rescue team), this may lead to disqualification.
  • The event organizers reserve the right to relocate or shorten the swimming course or to cancel the swimming event if weather conditions, water temperature, or overall water condition necessitate it.


CYCLING RULES


  • Drafting is not permitted in a non-drafter race. The 'drafting zone' is a 12-meter-long rectangle 3 meters wide (one and a half meters on both sides from the front wheel) between the leading point of the leading cyclist and the cyclist behind. An overtaking maneuver (completely passing the drafting zone) must be completed within 20 seconds. Subsequently, the overtaken athlete must have left the drafting zone of the first-mentioned athlete within 5 seconds.
  • The race numbers may not be reduced in size or otherwise altered. The number must be worn on the back while cycling.
  • Wearing a safe bicycle helmet is mandatory. The bicycle helmet must be secured with the chin strap before the bicycle is removed from the rack. Subsequently, the helmet may only be removed once the bicycle is back in the rack after the bicycle part has been completed.
  • Individual support is not permitted. The cycling course is closed to support vehicles. Participants may not seek or accept assistance from spectators, support staff, or third parties, with the exception of official technical support from the organization or within the coach stations.
  • A participant is personally responsible for the condition and any necessary repairs of the bicycle. The bicycle must be well-maintained and in a roadworthy condition prior to the start of the event. The participant must be capable and prepared to carry out any necessary repairs themselves; accepting assistance in this regard may lead to disqualification. This excludes the use of spare wheels or spare bicycles. A basic technical inspection will be performed upon checking in the bicycle, during which only bicycles meeting the requirements will be admitted to the transition zone. The helmet must be checked in at the same time as the bicycle and may only leave the transition zone during and after the race. Cyclists are expected to follow the instructions and directions of all race officials and authorities.
  • Participants are permitted to walk with the bicycle in hand if necessary.
  • Participants must keep to the right as much as possible on the course. Overtaking must take place on the left side.
  • The penalty for drafting, dangerous driving, and unsportsmanlike conduct is determined by the jury and may lead to disqualification.
  • The event organizers reserve the right to relocate or shorten the cycling course if weather or course conditions necessitate it.


RUNNING RULES


  • The race numbers may not be reduced in size or otherwise altered. The number must be worn on the front of the body while running.
  • Participants should walk on the right as much as possible so that passing on the left remains possible.
  • Participants are not allowed to run shirtless and must cross the finish line wearing a closed tri-suit.
  • Individual support on the course (in the form of non-participating runners, cyclists, or other vehicles) is not permitted. Accepting food or other items outside the coach post is not permitted and may lead to disqualification.
  • The event organizers reserve the right to relocate or shorten the running course if weather or course conditions necessitate it.


CUTOFF TIMES


Only in exceptional cases can and will we use Cutoff Times in DTS.

Sprint: We may remove you from the race and prevent you from starting the run if you arrive at T2 2 hours after the start (finished cycling and want to start running).

Olympic Distance: We may remove you from the race and prevent you from starting the run if you arrive at T2 3 hours after the start (finished cycling and want to start running).

1/3 Distance: We may remove you from the race and prevent you from starting the run if you arrive at T2 4 hours after the start (finished cycling and want to start running).

Middle Distance: We may remove you from the race and prevent you from starting the run if you arrive at T2 5.5 hours after the start (finished cycling and want to start running).
